THE DEBATE OF ETHICS AROUND IVF
The divorce rate in modern-day marriages is on the surge, the basic reason being the couples not being able to figure out some “Me time” and secondly because no factor exists between them to strengthen their marital bond. Factors can be a lack of sexual interest or a psychological connection which is only possible in the presence of children. But there are many concerns surrounding IVF. The major concern around IVF is its ethical binding, the ethics around IVF has been a major concern of debate. IVF is a complex procedure. It was introduced to India to bestow happiness to childless couples, but of late, the procedure of IVF has taken an ugly side.
The sale and purchase of artificially manufactured gametes is a legal concern. Secondly, the unhygienic procedures maintained in clinics can lead to problems for the mother, the child and the couple.
The Assisted reproduction technology bill 2020 requires both donors and the commissioning couple to share information with the National Registry and the National Board, keeping in mind the privacy of the couples.
The surrogacy regulation bill of the Indian constitution the bill provides a registry of clinics under the national board to comply with the procedures of IVF.
“Also, one major legal concern concerning IVF in the case of surrogate mothers is that the surrogate mother often tries to exercise authority over the child borne through her. The bill thus clearly states that the surrogate mother in no way shall have any authority over the child,” explained a doctor at a popular IVF centre in Punjab.
Let us first look at the ethical concerns surrounding the procedure of IVF:
- Consent of both the parties – The consent of both the parties, which is the commissioning couple and the clinic and the commissioning couple and the surrogate mother, if any, shall be made transparent. Any violations in consent as per the ART bill of 2020 and the surrogacy regulation bill of 2019 is a punishable offences. Any legal penalty shall not be reimbursed by the ART bank or added along with the test tube baby cost.
- Costs incurred have to be made clear – The cost of a test tube baby may vary per the standard of living across different cities. The cost of a test tube baby in Punjab may differ from that in Mumbai. Hence, the cost has to be made clear to the couple well in advance.
- SELF-DETERMINATION OR AUTONOMY – The commissioning couple should have complete authority over their embryo or child. Any information about any embryo investigation shall be transparent to the couple.
- JUST AND FAIR TREATMENT – The clinic or the art bank shall exercise impartiality about planting the embryo within the bodies of the female and shall not tamper with the inherent DNA of the embryo for the protection of the couple’s rights.
